NOTICE OF PROPOSED SETTLEMENT
The Department of Municipal Development (“DMD”) hereby gives notice that DMD will hold a public hearing on Tuesday, February 15, 2022, from 9 a.m. to 12 p.m., on the rule described below.
Proposed rule: ASE regulation
The purpose of this meeting is to seek public input on the city’s proposed by-law governing the imposition of fines and speed of community service pursuant to the Albuquerque Automated Speed Enforcement Ordinance (“Settlement”). The regulations implement certain provisions of the Automatic Speed Control Ordinance, ROA 1994, sections 7-15-1 to -5. Regulations:
- Provides that Automated Speed Enforcement System fines will not be issued unless a vehicle is traveling at least five (5) miles per hour over the speed limit for sections of freeways in safety zones, and at least ten (10) miles per hour above the speed limit for all other sections of freeways;
- Establishes a 30-day period within which the recipient of an ASE System Fine Notice (“Notice”) must respond;
- Provides that a registered owner or nominee must perform community service, if elected, within 90 days from the date of the notice; and
- Provides that if a registered owner or agent fails to comply with the promptness of settlement requirements, the registered owner is considered to be in default.
The public hearing allows members of the public to present testimony and arguments about the settlement.
The public hearing will be held via Zoom on Tuesday, February 15, 2022 from 9:00 a.m. to 12:00 p.m.:
